Terms of Service

These Terms of Service (“Terms”) govern your use of eliteepoxyandcoatings.com and any estimate, proposal, or coating work provided by Elite Epoxy & Coatings LLC (“Elite Epoxy,” “we,” “us,” or “our”). By using this website or accepting an estimate from us, you agree to these Terms.

1. About Us

Elite Epoxy & Coatings LLC is a Florida limited liability company providing concrete surface preparation and flake, epoxy, and polyaspartic floor coating services in Palm Beach and Broward County. We are registered and insured. Florida does not require a contractor license for epoxy and floor coating work of the type we perform.

2. Website Content

Content on this site is provided for general information only and does not constitute a binding offer, a guarantee of results, or professional advice about your specific slab. Photographs show completed work by Elite Epoxy; actual color, flake blend, sheen, and texture vary by product, lighting, and slab condition. Pricing information on the site is an estimate range only.

3. Estimates and Pricing

  • Quotes given by phone, text, email, or web form are preliminary until we perform an on-site assessment.
  • Final pricing depends on slab condition, square footage, required preparation, crack repair, moisture conditions, and the system selected.
  • Written estimates are valid for 30 days unless stated otherwise.
  • Additional work discovered after grinding begins, including unexpected moisture, contamination, delamination, or structural cracking, may require a change order and additional cost. We will notify you before performing extra work.

4. Scheduling and Installation

Coating work is performed as a multi-day, preparation-focused process. Installation timelines are estimates and may shift due to weather, humidity, ambient and slab temperature, cure times, material availability, or conditions discovered on site. Florida humidity and rain in particular can affect scheduling and cure windows.

Customer responsibilities

  • Clear the work area of vehicles, storage, shelving, and personal property before the crew arrives
  • Provide safe access to the work area, along with water and electrical power
  • Keep people and pets off the coated surface during the cure period we specify
  • Disclose any known moisture intrusion, prior coatings, sealers, or slab repairs

We are not responsible for damage to items left in the work area or for delays caused by inaccessible work areas.

5. Payment

A deposit may be required to schedule work, with the balance due on completion unless your written estimate states otherwise. Past-due balances may accrue interest at the maximum rate permitted by Florida law, and you agree to pay reasonable costs of collection, including attorney fees. We reserve the right to suspend work on accounts with past-due balances.

6. Cancellation

You may cancel or reschedule by contacting us. Cancellations made after materials have been ordered or custom-tinted, or within 48 hours of a scheduled start, may be subject to a fee covering materials and mobilization costs. Where a statutory right to cancel applies to a residential in-home sale, that right controls over this section.

7. Workmanship Warranty

We warrant our workmanship against delamination and peeling caused by defective installation for the period stated in your written estimate or invoice. Manufacturer warranties on coating products, where offered, pass through to you and are governed by the manufacturer’s terms.

We do not offer a lifetime warranty. Coating performance depends on conditions outside our control.

What the warranty does not cover

  • Moisture vapor transmission or hydrostatic pressure from below the slab, where a moisture vapor barrier was declined or where moisture conditions were not disclosed
  • Movement, settling, or new cracking of the concrete substrate
  • Damage from impact, dropped or dragged objects, or heavy or improperly loaded equipment
  • Hot tire pickup caused by parking vehicles on the floor before the full cure period has elapsed
  • Damage from chemicals, solvents, battery acid, de-icing salts, harsh cleaners, or improper maintenance
  • Normal wear, scratching, scuffing, fading, or gloss reduction, including UV-related color change on exterior surfaces
  • Work performed, altered, patched, or recoated by anyone other than Elite Epoxy
  • Floors where the customer declined recommended preparation, crack repair, or moisture mitigation

Warranty claims must be reported to us in writing within the warranty period. Our obligation is limited, at our option, to repairing or recoating the affected area or refunding the amount paid for that area.

8. Disclaimer

Except for the workmanship warranty stated above, our services are provided “as is” and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

9. Limitation of Liability

To the fullest extent permitted by Florida law, our total liability arising out of or relating to our services or this website will not exceed the amount you paid us for the work at issue. We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of use, loss of business, or property damage not caused by our negligence.

10. Intellectual Property

All content on this site, including text, photographs, logos, and the Elite Armor Coat™ name and system description, is owned by Elite Epoxy & Coatings LLC and may not be copied, reproduced, or used without our written permission.

11. Communications

By providing your phone number you consent to receive calls and text messages from us about your project. Message and data rates may apply, message frequency varies, and you may reply STOP to opt out at any time. See our Privacy Policy for details on how we handle your information.

12. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Florida without regard to conflict of law principles. The parties will first attempt to resolve any dispute informally by contacting each other. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and both parties consent to that venue.

13. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Your signed written estimate or contract, together with these Terms, forms the entire agreement between us and supersedes prior discussions. Where a signed written estimate conflicts with these Terms, the signed estimate controls.

14. Changes To These Terms

We may update these Terms at any time by posting a revised version on this page. The “last updated” date reflects the current version.
